Bad Faith Rules Apply to Continuing Baseless Suits

A recent court ruling has clarified when successful defendants in trade secrets lawsuits can recover attorney fees. Under the Uniform Trade Secrets Act, which is in effect in 47 states, filing a baseless suit can make attorneys’ fees recoverable.

Now, however, it is clear that if a plaintiff continues pursuing a lawsuit once it has become clear that it cannot hope to win it, the defendant may recover attorneys’ fees as well.
